Terms and Conditions

1. Scope

The following Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

2. Contracting party, formation of contract, correction options

The contract of sale is concluded with KENCANA GmbH.

By listing products in the online shop, we make a binding offer to conclude a contract for those products. You may initially place our products in your basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process. The contract is concluded when you accept the offer for the products contained in the basket by clicking the order button. You will receive a further confirmation by email immediately after submitting your order.

3. Contract language, storage of the contract text

We store the text of the contract and send you the order details and our Terms and Conditions in text form. You can view the text of the contract in our customer login area.

5. Delivery terms

5.1 Delivery area

We deliver within Germany.

5.2 Shipping costs

Standard delivery is free of charge for orders with a value of 24.90 euros or more, inclusive of VAT.

5.3 Delivery options

We ship products to the delivery address specified during the order process.

You generally have the option of collecting your order from KENCANA GmbH, Werkstraße 11b, 21218 Seevetal, Germany, during the following business hours: 8:30 am – 4:30 pm

6. Payment

6.1  Prices

The prices stated at the time of the order apply. These are total prices and include statutory VAT.

6.2 Payment methods

The following payment methods are generally available to you in our shop.

Advance payment
If you select advance payment as the payment method, we will provide our bank details in a separate email and dispatch the goods once payment has been received.

Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is available to consumers only. Unless otherwise specified below, payment via Klarna requires successful address and credit checks and is made directly to Klarna. Further information is provided with the respective payment option and during the order process.

Purchase on account via Klarna
The invoice amount is due 30 days after the goods have been dispatched and the invoice received.

Klarna may offer registered Klarna customers selected according to Klarna's own criteria further payment arrangements in their customer account. However, we have no influence on the provision of such arrangements; any further individually offered payment arrangements relate to your legal relationship with Klarna. Further information can be found in your Klarna account.

Klarna credit card
You provide your credit card details during the order process. Your card will be charged by Klarna immediately after the order is placed. No address or credit check is carried out.

Klarna direct debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you of the date your account will be debited (so-called pre-notification). The debit is made after the goods have been dispatched.

Instalment purchase via Klarna
You can pay the invoice amount in monthly instalments of at least 1/24 of the total amount. The minimum instalment amount is 6.95 euros.

Klarna may offer registered Klarna customers selected according to Klarna's own criteria further payment arrangements in their customer account (e.g. interest-free instalment plans). However, we have no influence on the provision of such arrangements; any further individually offered payment arrangements relate to your legal relationship with Klarna. PayPal
In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), we offer you the following payment options as PayPal Services. Unless otherwise specified below, payment via PayPal does not require registration with PayPal. Further information is provided with the respective payment option and during the order process.

PayPal, PayPal Express
To pay the invoice amount using the PayPal payment option, you must be registered with PayPal, verify yourself using your login details and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed.

PayPal may offer registered PayPal customers selected according to PayPal's own criteria further payment arrangements in their customer account. However, we have no influence on the provision of such arrangements; any further individually offered payment arrangements relate to your legal relationship with PayPal. Purchase on account via PayPal
Purchase on account via PayPal requires an address and credit check and is made directly to PayPal.

Purchase on account via PayPal and Ratepay
Purchase on account via PayPal requires an address and credit check and is made directly to Ratepay GmbH, Franklinstraße 28-29, 10587 Berlin ("Ratepay").

Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, verify yourself accordingly and confirm the payment instruction. Your account will be debited immediately after the order is placed. Further information is provided during the order process.

7. Warranty and guarantees

7.1 Liability for defects

Statutory liability for defects applies.

7.2 Guarantees and customer service

Information on any additional guarantees that may apply and their precise terms can be found with the relevant product and on special information pages in the online shop.

Customer service: No conditions apply

8. Liability

We shall be liable without limitation for claims arising from damage caused by us, our legal representatives or agents

  • in the event of injury to life, limb or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the event of a guarantee promise, insofar as agreed, or
  • insofar as the scope of the Product Liability Act applies.

In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the other party may regularly rely (cardinal obligations), caused by slight negligence on the part of us, our legal representatives or agents, liability shall be limited in amount to the damage foreseeable at the time the contract was concluded and typically to be expected.
Otherwise, claims for damages are excluded.

10. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here . We are willing to take part in an out-of-court dispute resolution procedure before a consumer arbitration board.

Should any individual clauses of these Terms and Conditions be, in whole or in part, invalid, the remainder of the contract shall remain valid. To the extent that individual clauses are invalid, the content of the contract shall be governed by the applicable statutory provisions.
